As tour consultants and travel agents, we facilitate, organize, and sell tour packages provided by various tour operators and service providers. These packages may include transportation, excursions, and accommodations, all of which are arranged by independent contractors beyond our direct management.
Mercury Tour Operator cannot be held liable for any bodily injury, accidents, property damage, or personal loss experienced by clients due to various factors, including but not limited to:
– Physical exertion beyond the client’s preparedness.
– Transportation via various modes such as planes, trains, cars, boats, or other means.
– Consumption of alcoholic beverages.
– Challenges of high altitudes.
– Natural occurrences like high winds, hurricanes, or flooding.
– Heat exhaustion.
– Civil unrest, terrorism, or related activities.
– Quality of medical services in remote areas.
Additionally, Mercury Tour Operator is not responsible for expenses such as meals, transportation, or hotel costs unless explicitly included in the tour package. In such cases, the responsibility lies with the actual service provider or tour operator.
We reserve the right to modify hotel arrangements or trip routes if deemed necessary to enhance tour quality or better accommodate our guests.
Mercury Tour Operator cannot be held accountable for any damage to clients’ personal belongings, including electronic devices, during the tour, whether due to water, accidents, loss, or theft.
Our maximum liability, under any circumstances, regarding any services offered, is limited to the total amount received from the client. We do not assume responsibility for any consequential loss, damage, or additional expenses incurred.
CLIENT’S ASSUMPTION OF RISKS
Clients and users of our services acknowledge the inherent risks associated with tours, including but not limited to physical exertion, transportation challenges, consumption of alcohol, high altitudes, natural forces, exhaustion, civil unrest, terrorism, wildlife encounters, medical service availability, and luggage issues.
RELEASE OF LIABILITY
Clients and users release Mercury Tour Operator from liabilities arising during the tour, except those resulting from our negligence.
Clients agree that this release of liability applies to them personally, as well as to their family members, minors traveling with them, and their heirs, successors, assigns, and legal representatives.
Mercury Tour Operator reserves the right to adjust tour prices without prior notice due to changes in airfares, currency fluctuations, fuel prices, etc.
We reserve the right to refuse or remove any person from a tour if they are deemed incapable of meeting its requirements or if their presence detracts from the enjoyment of others.
Clients are expected to adhere to all safety rules and guidelines provided by service providers.
We reserve the right to modify routes, hotels, and trip schedules as necessary to enhance the trip’s quality and ensure guest comfort and safety.
COMPLAINTS
Clients with grievances regarding our services can notify us within 7 days of availing the service, and we will endeavor to address them promptly. Complaints can be directed to info@mytourpackage.in.
LIMITED USE
Our services are intended for personal, family, or group use only, and commercial use is prohibited. Clients/users are not permitted to modify, distribute, reproduce, or sell any information or services obtained from our website without explicit permission.
ALTERATION IN PUBLISHED DESCRIPTION
While we strive for accuracy in our descriptions, we cannot be held responsible for errors or changes beyond our control. We do not operate airlines, buses, hotels, etc., and thus cannot prevent changes in published descriptions. Any necessary alterations will be communicated promptly to clients.
